
NevadaCivilRights.com and attorney Adam Breeden in January of 2025 filed a federal civil rights lawsuit against the Nye County Sheriff's Department and its Deputy for excessive force used against member of the public, David Provenza.
The lawsuit stems from an incident in March of 2024. The lawsuit alleges that Mr. Provenza was not a suspect in any crime and he had actually called for law enforcement assistance with a neighbor's escaped pitbull which was not the first incident of such an escape. During the encounter with police, which was captured on body worn camera, the officer became frustrated with Mr. Provenza and seemed to take offense with political comments Mr. Provenza had made toward a certain Presidential candidate. At some point, the Nye County Sheriff's deputy, in his own words from his report, "delivered several punches to David's face" causing blood to pour from his mouth and tased Mr. Provenza no less than four times. The elderly Mr. Provenza (70+ years old) can be heard begging for mercy and complaining he cannot breathe on the video.
